At all times during the Term, Licensee shall carry the types and levels of insurance set forth below and such insurance will be the primary coverages and looked to first with respect to any loss. The MATCH and the City of Houston, Texas shall be named as additional insured on the policy or policies. Licensee shall provide to the MATCH for its review and approval a certificate evidencing the Insurance prior to the commencement of the Term.
Licensee may alternatively purchase a Temporary Umbrella Liability Insurance Policy (TULIP) from the MATCH to satisfy this requirement. Licensee shall automatically be billed for TULIP if an approved certificate is not received prior to the start of the Term.
- Commercial General Liability, on a standard unmodified Insurance Service Office Occurrence policy form CG00010798 (or its equivalent) with no coverage deletion, with the following limits:
- General Aggregate Limit: $1,000,000
- Products Completed Operations Aggregate Limit: $1,000,000
- Personal and Advertising Injury Limit: $1,000,000
- Each Occurrence Limit: $1,000,000
- Fire Legal Liability Limit: $50,000
- Business Automobile Liability, covering the use, maintenance, or ownership of any vehicle by Licensee. Such insurance shall have the following limits:
- Combined Single Limit: $500,000 Each Accident.
- Liquor Liability, if Licensee or any entity employed by Licensee (subject to the MATCH’s sole and exclusive discretion and judgment) possesses a license from the Texas Alcoholic Beverage Commission, and/or is in the business of distributing, selling, serving or otherwise furnishing alcoholic beverages. Such insurance shall have the following limits:
- Per Occurrence: $1,000,000
- General Aggregate Limit: $1,000,000
- Worker’s Compensation and Employer’s Liability, if Licensee or any entity employed by Licensee employs any persons. Such insurance shall have the following limits:
- Medical and Indemnity Benefits Statutory
- Bodily Injury by Accident: $500,000 Each Accident
- Bodily Injury by Disease: $500,000 Each Employee
- Bodily Injury by Disease: $500,000 Policy Limit
All such insurance shall be effected under policies issued by insurers licensed to do business in the State of Texas and with a minimum rating of A- VII in the most recent issue of Best’s Guide to Property Liability Insurance Companies. All such policies shall state that such policy shall not be canceled without at least thirty (30) days prior written notice to the MATCH.
The MATCH and the City of Houston, Texas shall be named as additional insureds on the Liability policy or policies. Licensee shall provide to the MATCH for its review and approval a certificate evidencing the Insurance thirty days prior to the commencement of the Term.
